BESPOKE TERMS & CONDITIONS
Application and modifications of Czapek & Cie Terms and Conditions.
Please read these Terms & Conditions carefully. These Terms & Conditions are applicable to any order placed through our website or one of our Czapek Direct Sales representatives. Please note that before placing an order for products or services, you will be asked to agree to these Terms & Conditions. Sales concluded through third parties (such as authorized retailers) are not subject to these Terms & Conditions.
We may make changes from time to time to these Conditions of Sale so please check back regularly to keep informed of updates. The latest version of these Terms and Conditions will always be available on our website. Any new version of these Conditions of Sale shall take effect immediately upon the date of posting and will govern any orders of products or services made as from that date. By placing an order, you automatically agree to all Czapek & Cie Terms and Conditions.
Any changes to these Terms and Conditions made after you have placed an order will not affect that order and your relationship with Czapek & Cie, except as may be required by applicable law. Once your order is confirmed, all Terms and Conditions, including prices and refund policies, are fixed and will remain in force, even in case of modifications made after your order date .

Purchasing eligibility
Only individuals (and not legal entities) who (a) have reached the age of legal majority required to enter into contracts (eighteen in most countries); (b) have legal capacity to enter into contracts; and (c) use a shipping address in a country that we ship to, may order products through the Direct Sales Channel. If you are under the age of legal majority or otherwise cannot lawfully enter into a contract, you must have your parent or guardian place an order on your behalf and they will be asked to agree to these Terms & Conditions.
By placing an order through the Direct Sales Channel, you accept to refrain from reselling the product within 12 months and you represent and warrant that you are a bona fide end-user customer purchasing for your own or another’s personal use and will not deliver, sell or otherwise distribute our products or purchase our products or services for commercial purposes.
Bespoke Orders
Bespoke involves a lot of discussion and research. This is something we love to do, but it is important to understand that such projects are very demanding in terms of resources and time. Please be aware that a bespoke project can take up to a year or more to be finalized. Bespoke orders follow a four-step process:
1. Commitment fee — CHF 1,000
To confirm your interest and allow our team to dedicate the necessary time and resources to your project, a non-refundable commitment fee of CHF 1,000 is required upon submission of your bespoke request. This fee will be deducted from your production deposit. Should the project not reach completion, this fee may be converted into a credit note valid for any future purchase at Czapek & Cie.
Once paid, we will then establish a clear brief, produce a rendering and a detailed quotation, submitted for your validation.
2. Research & Development fee — CHF 5,000 (if applicable)
If technical developments are needed to establish our quotation, an R&D fee of CHF 5,000 will be requested to proceed. Should no viable technical solution be found, this fee will be refunded minus transactional fees and the project will be cancelled. If a technical solution has been found but you decide to cancel your order, the CHF 5,000 R&D fee will not be refundable but may be converted into a credit note valid for any future purchase at Czapek & Cie. If the project is validated, this fee, as much as the Commitment fee will be deducted from your production deposit.
At this stage, multiple renderings and a detailed final quotation will be submitted for your validation.
3. Production deposit — 50% of the validated quotation
Once the project is validated by both you and Czapek & Cie, a deposit representing 50% of the total final price (minus any fees already paid) is required to confirm your production intention and start your timepiece manufacturing. Production cannot start before this deposit is received and confirmed.
4. Final invoice
As soon as any deposit is executed, we will send you your advance payment receipt and an order confirmation. It is your responsibility to review the order confirmation. If you have any questions or concerns or if an order confirmation does not reflect your intentions, you should contact us at [email protected] without delay.
One week before the delivery of your timepiece, we will send you your final invoice for the remaining balance, after deduction of your production deposit. To cancel your order at any stage, you must contact us at [email protected].
All orders made through our Direct Sales Chanel that have been manufactured but not been fully paid and / or collected six months after the manufacturing date can be sold to another customer. No refund can then be claimed.
Order acceptance
We reserve the right to refuse or cancel an order in case of serious doubts about the customer's compliance with these terms and conditions or in case of arrears.
Prices, Taxes & Duties
All prices displayed in any Czapek documents or in any communication support (email, WhatsApp messages, phone) are not contractual and can be modified at any time. Only quotes or order acknowledgements (order confirmation) issued by Czapek & Cie are contractual. All prices are our international prices and do not include any taxes.
Please note that changes to applicable law between the date your order is placed and the date you are sent a written quote or an order acknowledgement (order confirmation) may result in changes to the taxes associated with your order. If the resulting change is an increase in the taxes that you are charged, we will contact you and ask that you reconfirm your order.
In case your purchase is delivered in another country than Switzerland, you might be requested by your country’s customs authorities to pay local VAT or/and other taxes before delivery can occur.
For US customers, all orders will be quoted and invoiced in USD. Your sale order includes shipping and all US federal taxes.
8.1% Swiss VAT is applied and added to all purchases collected in Switzerland.
If you are not a Swiss resident and are buying / picking up your purchase in Switzerland, you can claim for a full tax refund. This tax refund will be made by Czapek & Cie SA only after Swiss customs have checked, approved and returned to Czapek & Cie your tax refund documents. Failure to comply with this process will result in the loss of your tax refund rights.
The declaration of your purchases made in Switzerland to your country of residence customs authorities is your sole responsibility.

Shipping costs and insurances in relation with a watch purchase are included in the final price stated in your quote or order confirmation, (this excludes all services, accessories or repairs not covered by our international warranty).
If you order several products, we will ship the order only once all products are available (there will be no partial shipments unless otherwise communicated to you).
Return policy
Bespoke orders cannot be returned nor exchanged. No refunds are accepted.
Liability
We undertake to use our best endeavors to provide you with the best possible service quality consistent with the work done by all our employees. However, we cannot be held liable for any delay in delivering ordered articles, in particular for any delay in delivery of these articles by post, our order delivery partner, or its international partners.
Despite our vigilance and all the precautions taken by us in dealing with the partners with whom we work to enable you to benefit from the services offered by us, we do not guarantee the absence of any disturbance of the working of our website and the parts thereof. Consequently, we decline any liability for direct or indirect prejudice which may result from access to, or use of,
our website or some of its elements, just as we decline any liability which may result from the impossibility of accessing or using our website, such as breakdowns or interruptions, network overloaded, distortion of messages, deliberate clogging of the electronic network by third parties, access breaking down or made impossible by network operators ensuing impossibility for us to process your order in due time. Similarly, we decline all liability for all risks associated with the installation of software permitting consultation of our website or for any damage resulting from errors in transmission, technical faults, overload or interruptions of communications.
We have made all the necessary arrangements to ensure the security of your payments by credit card with our partner Stripe (www.stripe.com). However, we decline any liability for the use of this payment facility. In particular, you recognize that we cannot be liable for loss caused to you as a result of transmission errors, impersonation, forgery, hacking or deciphering by unauthorized persons or authorities (Swiss or foreign).
Applicable law
These Terms and Conditions are exclusively subject to Swiss law. The sole place of jurisdiction shall be Geneva, Switzerland, subject to mandatory places of jurisdiction as provided by law.
Each provision of these terms shall be construed separately and independently of each other. If any provision is deemed invalid, void or otherwise unenforceable, that provision shall be deemed severable from and not affect the enforceability of any of the other provisions of these terms.
